By creating an account, you agree to these Terms of Service and to our Privacy Policy. If you don't agree, don't use the Service.
Merrily is a wedding-planning tool: a guest list, a seating-chart planner, an expense tracker, and a place to track people helping you organize your wedding, shared between you and your co-organizers via an invite link.
You must be at least 16 years old to create an account.
When you add a guest, helper, or other third party's information to the Service, you are responsible for having a lawful basis to store and process that person's data (see our Privacy Policy, §2, for the controller/processor split). Only add information about real people in connection with your own wedding planning, and don't use the Service to build contact lists for unrelated purposes.
You agree not to:
The Service, its design, and its underlying software belong to inev-bit. You retain ownership of the data you enter (your guest list, expenses, etc.); you grant us the limited right to store and process it solely to provide the Service to you.
The core Service is free to use. An optional Premium subscription unlocks unlimited groups, categories, helpers, sharing with collaborators, and PDF exports for a single wedding. Pricing is shown before you're charged anything, and existing free functionality is never moved behind a paywall without advance notice.
Premium payments are processed entirely by the payment provider you choose — Stripe or PayPal on the web app, or the Apple App Store / Google Play Store in-app purchase system on the mobile app — under that provider's own terms. We never see or store your card number, PayPal password, or app‑store account credentials; we only receive a subscription confirmation and transaction ID from them. Cancelling, refunds, and billing disputes for a card or PayPal subscription are handled by contacting us (see §15); for an App Store or Play Store subscription, cancellation and refunds are handled directly through that store's own subscription-management tools, per Apple's and Google's respective policies — we have no ability to issue a refund on their behalf. Downgrading from Premium never deletes or hides any data you already created; it only stops further creation past the free-tier limits described in the app.
EU right of withdrawal. If you are a consumer in the EU/EEA, you would normally have a 14-day right to withdraw from an online purchase without giving a reason (Directive 2011/83/EU on consumer rights, as implemented in German and other member states' law). Premium is digital content/a digital service supplied to you immediately rather than on a tangible medium, so under that Directive this withdrawal right ends once performance has begun with your express request and your acknowledgment that you thereby lose the right of withdrawal — which is exactly what happens when you complete a Premium checkout and Premium features are activated on your account right away. If you believe Premium was activated before you gave that consent, or you want to withdraw before it's actually applied, contact us immediately at inev-bit@mailbox.org; once the subscription has been activated at your own request and used, no refund is owed under the withdrawal right beyond what applicable law otherwise requires. This is separate from, and doesn't reduce, the App Store/Play Store cancellation and refund process described above for a mobile in-app purchase.
We may in the future show advertising (e.g. via Google Ads) or run a referral program. Any such change will be reflected here and in our Privacy Policy before it takes effect, including any cookie-consent requirements that come with it.
You may delete your account at any time. We may suspend or terminate accounts that violate these terms, with notice where reasonably possible. On deletion, your data is removed per the retention terms in our Privacy Policy.
The Service is provided "as is". We do not guarantee it will be uninterrupted, error-free, or fit for any particular purpose beyond what's described here. You're responsible for keeping your own backups of anything mission-critical (e.g. exporting your guest list before a major life event that depends on it).
To the fullest extent permitted by law, inev-bit is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these terms limits liability that cannot be excluded under German law (e.g. for intent or gross negligence, or injury to life, body, or health).
These terms are governed by the laws of Germany, without regard to conflict-of-law principles. Where you are a consumer, mandatory consumer-protection provisions of your own country of residence, if within the EU, may also apply.
We may update these terms from time to time; the "last updated" date above will change, and material changes will be highlighted to registered users before they take effect.
